1. Agreement to These Terms
Welcome to Pink Slip Racing.
These Terms of Service (“Terms”) form a legally binding agreement between you and NyFTee Original LLC (“NyFTee,” “Pink Slip Racing,” “PSR,” “we,” “us,” or “our”).
These Terms govern your access to and use of:
- The Pink Slip Racing website at https://psrgame.com;
- The Pink Slip Racing game and Live Alpha;
- PSR accounts, garages, races, crates, vehicles, parts, currencies, marketplaces, leaderboards, social features, and related services;
- Any future mobile, desktop, downloadable, hosted, or connected version of Pink Slip Racing; and
- Any other service that links to these Terms.
Together, these are called the “Service.”
By creating an account, accessing the authenticated game, purchasing a product, clicking an acceptance button, or otherwise using the Service, you acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy.
If you do not agree to these Terms, do not create an account, purchase anything, or use the Service.
2. Important Notice About Arbitration
These Terms contain a binding individual arbitration agreement and class-action waiver in Section 27. Unless you timely opt out, you and NyFTee agree to resolve most disputes through individual arbitration instead of a lawsuit before a judge or jury.
Please read Section 27 carefully.
3. Eligibility
You must be at least eighteen years old and legally capable of entering into a binding contract to use Pink Slip Racing.
By accessing or using the Service, you represent that:
- You are at least eighteen years old;
- You have the legal capacity to accept these Terms;
- You are not prohibited from using the Service under applicable law;
- Your use of the Service is lawful in your location;
- You are not located in a jurisdiction subject to applicable United States trade sanctions or embargoes that prohibit your use of the Service; and
- All information you provide is truthful, accurate, current, and complete.
Pink Slip Racing is not directed to children under thirteen, and we do not knowingly permit children under eighteen to create accounts.
We may require age, identity, location, payment, tax, or eligibility verification before granting access to specific features.
4. Pink Slip Racing Live Alpha
Pink Slip Racing is currently offered as a Live Alpha product.
The Live Alpha is an unfinished test environment intended to help NyFTee evaluate and improve game systems, balance, security, performance, racing, progression, asset records, payments, and the in-game economy.
You acknowledge that the Live Alpha may contain:
- Bugs, errors, missing features, incomplete content, and balancing problems;
- Temporary or experimental rules;
- Unannounced downtime or maintenance;
- Data corrections, rollbacks, inventory adjustments, and economy resets;
- Changes to vehicles, parts, statistics, race results, rewards, prices, crate contents, and progression;
- Features that are disabled, restricted, simulated, or available only to authorized testers; and
- Data that may be lost, modified, or deleted.
Alpha progress does not carry over
Unless NyFTee expressly announces otherwise in writing, Alpha accounts, assets, balances, statistics, race history, achievements, marketplace records, and progression will not carry over into Beta or the commercial release.
NyFTee may reset or retire any Alpha data when necessary for testing, security, balancing, legal compliance, or release preparation.
Promotional Alpha rewards, including rewards offered to early verified drivers, are promotional testing benefits. They do not create a cash entitlement, vested property right, or guarantee of equivalent Beta or release content.
Eligible Alpha participants may receive a separate Beta recognition reward. The form, timing, eligibility rules, and value of that reward remain subject to future announcement.
5. Accounts and Account Security
Certain parts of the Service require a registered account.
You agree to:
- Maintain accurate account information;
- Keep your login credentials and connected authentication accounts secure;
- Use only accounts you own or are authorized to use;
- Notify us promptly if you suspect unauthorized access;
Accept responsibility for activity occurring through your account; and
- Follow reasonable security or identity-verification requests.
You may not sell, rent, lease, share, sublicense, transfer, or commercially exploit your account.
One person may not operate multiple accounts to manipulate rewards, evade restrictions, abuse promotional offers, influence races, launder currency, evade enforcement, or gain an unfair advantage.
We may restrict duplicate or related accounts based on device, payment, identity, network, behavioral, or other security signals.
Third-party authentication providers, including Google, may be used to authenticate your identity. Your use of a third-party provider is also governed by that provider’s terms and privacy practices.
6. Limited License to Use the Service
Subject to these Terms, NyFTee grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Service for lawful personal entertainment.
This license does not transfer ownership of:
- The Pink Slip Racing software;
- Game code or systems;
- Vehicle, part, crate, track, driver, or interface artwork;
- Names, brands, logos, lore, designs, audio, animations, or visual effects;
- The NyFTee Physics Engine;
- Chain-of-custody or validation systems;
- Asset-generation systems;
Game databases or records; or
- Any other intellectual property belonging to NyFTee or its licensors.
Any rights not expressly granted are reserved by NyFTee.
7. Titled Game Assets and Pink Slips
Pink Slip Racing uses game records commonly described as “titles,” “pink slips,” “titled vehicles,” “titled parts,” “assets,” “ownership records,” or “chain-of-custody records.”
These terms describe a player’s recorded control of an item inside Pink Slip Racing.
A PSR title may record information such as:
- Current account assignment;
- Mint or serial number;
- Vehicle or part identity;
- Rarity and attributes;
- Race, repair, upgrade, or installation history;
- Previous transfers or owners;
Provenance events; and
- Other game-specific metadata.
What a title represents
Subject to these Terms, a valid title gives your account the right to possess, use, race, upgrade, repair, display, trade, or list the associated Game Asset through the features PSR makes available.
What a title does not represent
A PSR title or Game Asset is not:
- Legal title to a real vehicle or physical product;
- A deed, certificate of title, or government-issued ownership document;
- A security, stock, bond, investment contract, or ownership interest in NyFTee;
- A bank account, deposit account, or stored-value account;
- Cryptocurrency;
- An NFT;
- A guarantee of profit, appreciation, liquidity, or resale value;
- Ownership of PSR artwork, software, trademarks, or intellectual property; or
- An independently usable asset outside the Service.
The phrase “OWN YOUR ASSETS” means that PSR records and recognizes your control over eligible Game Assets within the Pink Slip Racing ecosystem, subject to these Terms, game rules, technical availability, and lawful enforcement actions.
NyFTee retains ownership of the Service and all underlying intellectual property.
8. Slip Tokens — ST
“ST” means Slip Tokens, the primary free-to-play and progression currency used within Pink Slip Racing.
ST may be earned, granted, awarded, or purchased through authorized PSR features.
ST:
- May be used only for eligible PSR activities;
- Is not legal tender;
- Is not a cryptocurrency or financial account;
- Has no guaranteed exchange rate or market value;
- Cannot be withdrawn, redeemed, or cashed out;
- Does not earn interest;
- Cannot be transferred outside authorized PSR features;
Cannot be sold independently of the Service; and
- Is not an investment product.
A display that resembles a monetary denomination is an interface convention used to make game pricing easier to understand. It does not make ST redeemable for United States dollars.
NyFTee may adjust, correct, reverse, suspend, or remove ST when reasonably necessary to address fraud, errors, unauthorized issuance, duplicate fulfillment, chargebacks, exploits, economy balancing, enforcement actions, or Alpha resets.
Purchased ST remains a digital in-game product and does not become cash or refundable stored value after it has been delivered, except where applicable law requires otherwise.
9. Backed Slip Tokens — Retired
“BST” means Backed Slip Tokens, a retired legacy PSR accounting concept.
BST is not an active public currency or marketplace settlement method during Live Alpha.
Players cannot create, purchase, receive, spend, transfer, redeem, withdraw, cash out, or settle C‑Bay transactions in BST.
Any historical BST fields or records are retained only for audit, compatibility, reconciliation, or legal recordkeeping. They do not create a current player balance, cash value, payout right, or marketplace right.
NyFTee may quarantine, correct, void, or remove invalid legacy BST records connected to an exploit, administrative error, counterfeit transaction, manipulated ledger event, or unauthorized source.
BST will not return as a public feature unless NyFTee adopts new rules and provides any legally required disclosures, approvals, and notices.
10. Crates, Rewards, and Randomized Content
Pink Slip Racing may offer vehicle crates, parts crates, driver crates, track crates, race reward crates, and other randomized or partially randomized digital products.
Before completing an eligible paid crate purchase, PSR may display information such as:
- The crate type;
- Included item categories;
- Possible rarities;
- Published odds or probability ranges;
Purchase price; and
- Any guaranteed contents.
Crate results are generated according to the active game configuration at the time the crate is opened or fulfilled.
Purchasing a crate does not guarantee a specific brand, model, part, rarity, attribute roll, market value, competitive result, or resale opportunity unless the checkout page expressly states that the result is guaranteed.
Crate contents:
- Are digital game content;
- Have no guaranteed cash value;
- Cannot be exchanged merely because the result was unwanted;
- May be modified for balancing, bug correction, legal compliance, or Alpha testing; and
- Remain subject to the Live Alpha reset policy.
PSR may correct an incorrectly generated or duplicated crate result when supported by audit records.
11. Purchases and Payment Processing
Pink Slip Racing may offer digital products through the Slipbox Depot or another authorized PSR storefront.
Products may include:
- ST packages;
- Vehicle, parts, driver, track, or mixed crate packs;
- Race Passes;
- Cosmetics;
Services, repairs, or upgrades; and
- Other clearly identified digital content.
Prices, included content, taxes, fees, and applicable conditions will be displayed before checkout.
Payments may be processed through PayPal or another authorized payment provider. NyFTee does not receive or store your complete payment-card or bank-account credentials when payment is handled directly by the payment provider.
You authorize NyFTee and its payment providers to charge the amount displayed at checkout, including applicable taxes and disclosed fees.
A payment is not complete until it has been successfully approved, captured, verified, and accepted by the relevant systems.
We may withhold fulfillment while a transaction is pending, under review, disputed, reversed, suspected of fraud, or not successfully captured.
Your use of PayPal is also subject to PayPal’s applicable agreements and policies.
12. Refunds, Failed Fulfillment, and Payment Disputes
Except where required by law or expressly stated at checkout, purchases of delivered digital content are final.
We may provide a refund, replacement, correction, or account credit when:
- A payment was captured more than once;
- The purchased content was not delivered;
- The wrong product was delivered;
A verified technical error prevented fulfillment; or
- Applicable law requires a remedy.
A request based solely on dissatisfaction with a randomized crate result, race outcome, attribute roll, balance change, or Alpha reset does not ordinarily qualify for a refund.
Before initiating a payment dispute or chargeback, contact us at admin@psrgame.com so we can investigate the transaction.
Nothing in these Terms prevents you from exercising non-waivable rights through your payment provider or applicable law.
If a purchase is reversed, refunded, charged back, or determined to be unauthorized, NyFTee may remove the associated ST, crates, passes, Game Assets, rewards, or proceeds. If the associated content has already been used or transferred, we may place an equivalent hold or adjustment on the account while the matter is investigated.
Fraudulent disputes, intentional chargeback abuse, or attempts to retain both a payment refund and the associated digital content may result in account restriction or termination.
13. Race Passes and Time-Limited Benefits
Pink Slip Racing may offer Basic, Premium, promotional, or other Race Passes.
The purchase screen will describe:
- The applicable price;
- The pass duration or season;
- Included rewards or benefits;
Eligibility conditions; and
- Whether the pass renews.
A Race Pass does not automatically renew unless the checkout page clearly discloses recurring billing and you separately authorize it.
Unused pass rewards may expire when the relevant pass or season ends. Alpha passes and benefits may be modified or concluded as part of testing, subject to applicable law and any specific checkout disclosures.
14. Races and Competitive Play
Pink Slip Racing includes simulated Drag, Sprint, Drift, and other racing modes.
Race outcomes may be influenced by:
- Vehicle and part attributes;
- Condition, durability, repairs, and upgrades;
- Driver or track factors;
- Player timing or influence events;
- Matchmaking;
- The NyFTee Physics Engine;
Randomized or simulated conditions; and
- Other disclosed game systems.
No particular race result is guaranteed.
Race entry costs, reward pools, house fees, prizes, and eligibility conditions will be displayed or governed by the active race rules.
ST-based racing is entertainment gameplay using non-redeemable game currency. It does not create a right to receive money.
BST-based competitions, cash prizes, or cash-out-related race features will not be available unless NyFTee expressly enables them after completing the necessary legal, compliance, payment, and jurisdictional review.
You may not use PSR for unlawful gambling, money laundering, payment cycling, collusion, match fixing, or any other prohibited financial activity.
15. C‑Bay First‑Party Asset Sales
“C‑Bay” is PSR’s first‑party digital asset storefront. NyFTee Original LLC / Pink Slip Racing is the sole seller and merchant of record.
During Live Alpha, only eligible PSR-owned vehicles, PSR-authorized drivers, track tiles, and complete identified material batches may be listed. Founder and Co‑Founder accounts may curate corporate inventory but do not act as personal sellers and receive no proceeds, revenue split, or payout. Parts, crates, player-owned inventory, and partial material stacks are not offered unless PSR expressly enables them under updated terms.
Only eligible non-founding player accounts may purchase C‑Bay inventory. Player listings, seller onboarding, seller payouts, PayPal Multiparty routing, auctions, bids, BST settlement, and ST settlement are disabled.
C‑Bay purchases are denominated in USD and processed through the displayed PayPal checkout. The buyer total equals the displayed asset price; C‑Bay adds no platform, P&P, titling, seller, or buyer fee. PayPal may apply its own funding or currency-conversion terms directly to the buyer where applicable.
A listed asset is placed into system custody. Ownership transfers only after PSR verifies a completed PayPal capture for the exact order, amount, currency, merchant account, listing, buyer, asset type, asset identifier, and listed quantity. Browser redirects, query parameters, approvals without capture, failed payments, cancelled payments, and abandoned checkouts cannot transfer an asset.
Provider events and fulfillment are idempotent. A completed purchase cannot transfer the same asset twice. Refunds, reversals, disputes, or chargebacks after transfer require review under PSR’s reconciliation and enforcement rules and do not automatically rewrite provenance history.
Buyers are responsible for reviewing available title, history, appraisal, compatibility, and condition information. NyFTee does not guarantee that a Game Asset will retain value or remain eligible for future transactions. Availability may depend on jurisdiction.
16. Vehicle Trades
PSR may permit direct vehicle trades under active game rules.
Unless PSR expressly changes those rules:
- Vehicles may be traded only for another vehicle of equal rarity;
- Cross-rarity trades are not permitted;
- A vehicle may not be traded for a combination of another vehicle and BST;
- Each participant must pay the displayed trade fee;
- The established trade fee is 250 BST per participant when BST trade settlement is enabled;
Installed parts remain attached to the traded vehicle; and
- Mechanic reset, inspection, and title-transfer rules continue to apply.
Both participants are responsible for reviewing the vehicle, title record, installed parts, condition, and available history before accepting a trade.
A completed trade is final unless reversed because of fraud, account compromise, invalid funds, system error, or another enforceable PSR rule.
17. Founder, Co‑Founder, Administrative, and Test Accounts
Authorized Founder, Co‑Founder, administrator, operator, and testing accounts may receive access not available to ordinary players.
Authorized privileges may include:
- Waived-cost access to PSR-owned products or services;
- Operational crate or asset grants;
- Testing balances;
- Administrative controls;
- Supply validation;
Economy testing; and
- Access to unfinished features.
These actions are operational activities and do not represent ordinary consumer purchases.
A Founder or operator waiver:
- Does not create a PayPal order or captured payment;
- Does not create BST;
- Does not create recognized purchase revenue;
Must be recorded through an authorized audit or ledger path; and
- Cannot be used by a Founder or Co‑Founder account to purchase first‑party C‑Bay inventory.
Founder and Co‑Founder accounts may curate eligible PSR-owned C‑Bay vehicles, PSR-authorized drivers, track tiles, and complete material batches as corporate operators. They may not list personal assets, purchase C‑Bay inventory, receive personal C‑Bay proceeds, or receive a revenue split or seller payout. All C‑Bay proceeds belong to NyFTee Original LLC / Pink Slip Racing.
Administrative privileges do not permit manipulation of ordinary player results or unauthorized creation of backed value.
18. Prohibited Conduct
You may not:
- Cheat, use bots, macros, scripts, automation, or unauthorized assistance;
- Exploit bugs, race conditions, duplicate fulfillment, or economy vulnerabilities;
- Manipulate races, matchmaking, leaderboards, odds, statistics, rewards, or marketplace activity;
- Create, obtain, transfer, or spend unauthorized ST or BST;
- Launder value through races, trades, purchases, listings, refunds, or related accounts;
- Engage in collusion, wash trading, fake sales, self-dealing, price manipulation, or coordinated market abuse;
- Use stolen, unauthorized, or fraudulent payment methods;
- Abuse refunds, chargebacks, promotional offers, or referral systems;
- Access another person’s account without authorization;
- Impersonate another person, NyFTee representative, administrator, or partner;
- Harass, threaten, stalk, defraud, or abuse another user;
- Post unlawful, hateful, sexually exploitative, threatening, infringing, or malicious content;
- Attempt to obtain another user’s credentials or sensitive information;
- Reverse engineer, decompile, scrape, probe, or bypass the Service except where a legal right cannot be waived;
- Interfere with servers, networks, security controls, rate limits, authentication, or payment systems;
- Upload malware or harmful code;
- Buy, sell, rent, or transfer accounts;
- Conduct off-platform sales of PSR accounts, ST, BST, titles, or Game Assets;
- Use PSR trademarks or content in a way that suggests unauthorized sponsorship;
- Use the Service for unlawful gambling, fraud, sanctions evasion, money transmission, or other illegal activity; or
- Help another person perform any prohibited act.
19. Monitoring, Auditing, and Enforcement
To protect the Service, NyFTee may monitor and analyze account, device, race, inventory, title, ledger, payment, marketplace, and security events.
NyFTee may use automated and manual tools to identify:
- Fraud;
- Exploits;
- Duplicate or related accounts;
- Unauthorized currency creation;
- Invalid source-of-funds;
- Suspicious transfers;
- Collusion;
- Chargeback abuse;
Account compromise; and
- Violations of these Terms.
When reasonably necessary, we may:
- Delay or block a transaction;
- Freeze an account or asset;
- Quarantine ST, BST, or Game Assets;
- Correct a balance or title record;
- Reverse an unauthorized transfer;
- Remove improperly obtained rewards;
- Require additional verification;
- Restrict marketplace or payment access;
Suspend or terminate an account; or
- Refer suspected unlawful activity to payment providers or authorities.
We will use available audit information when reviewing enforcement decisions, but we are not required to disclose confidential detection methods, security models, or information that could help users evade enforcement.
20. User Content
The Service may allow you to submit usernames, profiles, crew information, messages, feedback, reports, images, or other content (“User Content”).
You retain any ownership rights you already hold in your User Content.
You grant NyFTee a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, adapt, display, distribute, and use your User Content as reasonably necessary to operate, secure, promote, and improve the Service.
You represent that:
- You own or have permission to submit the User Content;
- The content does not violate another person’s rights;
The content is not unlawful or malicious; and
- Our permitted use will not violate any agreement to which you are bound.
We may remove or restrict User Content that violates these Terms or creates risk to the Service or its users.
21. Feedback and Alpha Testing Contributions
You may provide ideas, suggestions, bug reports, balancing observations, designs, or other feedback.
You grant NyFTee a perpetual, irrevocable, worldwide, royalty-free right to use, modify, commercialize, and incorporate that feedback without restriction or compensation.
This does not transfer ownership of your independently created pre-existing intellectual property, but it allows NyFTee to use the feedback itself and any improvements derived from it.
22. Intellectual Property
Pink Slip Racing, PSR, NyFTee Original, associated logos, the PSR interface, title system, asset presentation, original fictional vehicle and part brands, game artwork, code, designs, text, audio, video, and other original materials are owned by or licensed to NyFTee.
You may not reproduce, distribute, sell, license, publicly display, modify, or create commercial derivative works from PSR content unless NyFTee has provided written authorization.
Limited noncommercial screenshots, videos, reviews, livestreams, and fan commentary are permitted when they:
- Clearly identify Pink Slip Racing;
- Do not disclose confidential testing information;
- Do not misrepresent an official partnership;
Do not contain unlawful or infringing material; and
- Follow any published creator guidelines.
23. Copyright Complaints
If you believe content on the Service infringes your copyright, send a written notice to:

Your notice should include:
- Identification of the copyrighted work;
- Identification and location of the allegedly infringing material;
- Your contact information;
- A statement of your good-faith belief that the use is unauthorized;
- A statement, under penalty of perjury, that the notice is accurate and that you are authorized to act; and
- Your physical or electronic signature.
Knowingly submitting a materially false infringement notice may create legal liability.
24. Third-Party Services and Links
The Service may connect to or contain links to third-party services, including:
- Google authentication;
- PayPal payment processing;
- Hosting and infrastructure providers;
- Community platforms;
Social media; and
- Other integrations.
NyFTee does not control every third-party service and is not responsible for its independent availability, content, security, or conduct.
Your use of a third-party service may be governed by separate terms and privacy policies.
The inclusion of a third-party integration does not necessarily mean NyFTee endorses every service, statement, product, or policy offered by that provider.
25. Availability, Changes, and Service Termination
We may update, modify, suspend, discontinue, replace, or remove any portion of the Service.
This may include changes to:
- Game rules and balance;
- Vehicles, parts, statistics, durability, or compatibility;
- Races and reward structures;
- Crates and available products;
- ST or BST functionality;
- Prices and fees;
- Marketplace or trade systems;
- Alpha data and progression;
- Account requirements;
Technical platforms; and
- Regional availability.
We do not guarantee that the Service, a specific feature, or any Game Asset will always remain available.
Where legally required, we will provide appropriate notice or remedies for material changes affecting purchased digital content.
26. Suspension and Termination
You may stop using the Service at any time.
You may request account deletion using the process described in the Privacy Policy or by contacting admin@psrgame.com.
NyFTee may suspend, restrict, or terminate your access when we reasonably believe:
- You violated these Terms;
- Your account presents a fraud, security, legal, or financial risk;
- You engaged in prohibited conduct;
- Your payment was reversed or unauthorized;
- Verification requirements were not satisfied;
- Continued access could harm PSR or another person;
We are required to act by law or a service provider; or
- The Service or applicable feature is being discontinued.
Termination may result in loss of access to the account, ST, BST, titles, Game Assets, passes, progression, and other digital content, subject to applicable law.
Sections that by their nature should survive termination will survive, including provisions concerning intellectual property, payments, disputes, disclaimers, liability, indemnification, and enforcement.
27. Dispute Resolution, Arbitration, and Class-Action Waiver
27.1 Informal resolution first
Before filing arbitration or a lawsuit, the complaining party must send an individual written Notice of Dispute.
Notices to NyFTee must be sent to:
admin@psrgame.com
The notice must include:
- The account holder’s name and account email;
- A description of the dispute;
- The relevant transaction or event;
The requested resolution; and
- Information reasonably necessary to investigate the claim.
The parties will attempt in good faith to resolve the dispute for at least thirty days after receipt of a complete notice.
27.2 Binding individual arbitration
If the dispute is not resolved informally, either party may elect binding individual arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules.
The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.
Arbitration may be conducted by video, telephone, written submissions, or in person, as permitted by the applicable rules.
27.3 Exceptions
Either party may bring an eligible individual claim in small-claims court.
Either party may also seek temporary or preliminary court relief necessary to protect intellectual property, confidential information, account security, payment systems, or the integrity of the Service while arbitration is pending.
Nothing in this section prevents you from reporting a matter to a government agency.
27.4 No class or representative proceedings
You and NyFTee agree that claims may be brought only on an individual basis.
Neither party may bring or participate in a class action, collective action, consolidated action, private-attorney-general action, or representative proceeding.
An arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party’s individual claim.
27.5 Arbitration opt-out
You may opt out of arbitration by emailing admin@psrgame.com within thirty days after you first accept these Terms.
Your opt-out notice must include:
- Your full name;
- Your PSR account email;
- A clear statement that you are opting out of the arbitration agreement; and
- The date of your notice.
Opting out of arbitration will not affect the remaining Terms or your ability to use the Service.
27.6 If arbitration does not apply
For disputes not subject to arbitration, you and NyFTee consent to the exclusive jurisdiction of the state and federal courts located in Pima County, Arizona, unless applicable law gives you the right to bring a claim elsewhere.
28. Governing Law
These Terms are governed by the laws of the State of Arizona and applicable federal law, without regard to conflict-of-law rules.
This choice of law does not deprive you of any non-waivable consumer protection provided by the law of your place of residence.
29. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.”
NyFTee disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and uninterrupted operation.
We do not warrant that:
- The Service will always be available, secure, or error-free;
- Alpha data will be preserved;
- Any defect will be corrected immediately;
- Any Game Asset will retain attributes, rarity, usefulness, or value;
- A player will win a race or receive a specific reward;
- A marketplace buyer or seller will be available;
- BST, C‑Bay, resale, or cash-out will launch;
A Game Asset will have a resale market; or
- Use of the Service will generate income or profit.
Some jurisdictions do not allow certain warranty disclaimers, so portions of this section may not apply to you.
30. Limitation of Liability
To the maximum extent permitted by law, NyFTee and its owners, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages, including lost profits, lost opportunities, lost data, loss of goodwill, or loss of anticipated Game Asset value.
To the maximum extent permitted by law, NyFTee’s total liability arising from the Service or these Terms will not exceed the greater of:
- The amount you paid directly to NyFTee during the six months preceding the event giving rise to the claim; or
- One hundred United States dollars.
These limitations do not apply to liability that cannot lawfully be limited, including liability for intentional misconduct or other rights that applicable law makes non-waivable.
31. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless NyFTee and its owners, officers, employees, contractors, licensors, and service providers from third-party claims arising from:
- Your unlawful use of the Service;
- Your User Content;
- Your violation of another person’s rights;
- Your fraudulent or unauthorized transactions;
Your violation of these Terms; or
- Your intentional misconduct.
NyFTee may assume control of the defense of a covered claim. You agree to reasonably cooperate with that defense.
32. Taxes
You are responsible for taxes arising from your purchases, marketplace sales, payouts, or other use of the Service, except taxes imposed directly on NyFTee’s income.
If seller payouts or cash-out features are enabled, NyFTee or its payment providers may:
- Request tax identification information;
- Report transactions as required by law;
Withhold amounts when legally required; or
- Restrict payouts until required information is provided.
NyFTee does not provide tax, investment, financial, or legal advice.
33. Changes to These Terms
We may update these Terms as the Service changes.
When we make material changes, we may provide notice through the website, game interface, account email, or another reasonable method.
The “Last Updated” date will identify the latest version.
If a change materially affects your rights, we may require renewed acceptance before continued use.
Your continued use after the effective date of updated Terms constitutes acceptance, except where applicable law requires a different form of consent.
Changes to the arbitration section will not apply retroactively to a dispute for which a complete written Notice of Dispute was received before the updated terms took effect.
34. Electronic Communications
You agree that NyFTee may provide agreements, notices, receipts, disclosures, transaction records, and other communications electronically.
Electronic communications may be delivered through:
- The PSR website or game interface;
- Your account;
The email address associated with your account; or
- Another electronic method you authorize.
You are responsible for maintaining a valid email address and reviewing account notices.
You may retain a copy of these Terms by printing or saving this page.
35. General Provisions
Entire agreement
These Terms, the Privacy Policy, applicable checkout disclosures, marketplace rules, event rules, and other policies expressly incorporated by reference form the complete agreement between you and NyFTee concerning the Service.
Order of precedence
If a specific purchase, event, marketplace, or promotion displays additional terms, those specific terms control for that feature to the extent they conflict with these general Terms.
Severability
If any provision is found unenforceable, it will be enforced to the greatest lawful extent, and the remaining provisions will continue in effect.
No waiver
Failure to enforce a provision is not a waiver of the right to enforce it later.
Assignment
You may not assign or transfer your rights under these Terms without written permission from NyFTee.
NyFTee may assign these Terms as part of a merger, acquisition, financing, restructuring, sale of assets, or transfer of the Service.
No third-party beneficiaries
These Terms do not create enforceable rights for anyone other than you and NyFTee, except where expressly stated.
Headings
Section headings are provided for convenience and do not limit the meaning of the Terms.
Force majeure
NyFTee is not responsible for delay or failure caused by events reasonably beyond its control, including natural disasters, utility failures, internet outages, cyberattacks, labor disputes, governmental actions, payment-provider outages, hosting failures, or other force-majeure events.
